Terms & Conditions

The simple, straightforward agreement behind every direct booking with us.

No fine print traps — just what you can expect from us, and what we ask of you.

These terms apply to all direct bookings made with Escapes to Samui, operated by Indulgent Escapes 2 Samui Co. LTD trading as Escapes to Samui.com ("Escapes to Samui", "we", "us"). The property you have booked is referred to as "the Villa". Paying a deposit or the full amount confirms that you have read and accepted these terms.

Bookings made through Airbnb, VRBO or other platforms follow that platform's own payment and cancellation policies. Our house rules (sections 5 to 8) apply to every stay, however you booked.

We may update these terms from time to time. The version in place on the date of your booking is the one that applies to your stay.

1. Bookings

1.1 Availability and rates. When you ask about availability, we will confirm the nightly rate, the total price and the deposit needed to secure your dates. Bookings are confirmed in the order payments are received.

1.2 What's included. Rates are per night and include use of the Villa and its facilities as described on the listing. They do not include personal expenses, extra services (such as chefs, transfers or excursions), extra cleaning beyond normal use, or the replacement of broken or damaged items. Normal wear and tear is fine.

1.3 Check-in and check-out. Check-in is from 3:00 PM and check-out is by 11:00 AM. If you need different times, just let us know and we will do our best to arrange it.

1.4 Guests. Only the guests named on the booking may stay at the Villa, up to the maximum occupancy agreed in advance. If anything changes in your group, please let us know as soon as possible.

2. Payments

2.1 If you have paid a deposit, the remaining balance is due no later than 30 days before arrival. For bookings made less than 30 days before arrival, full payment is due at the time of booking.

2.2 If the balance is not received on time, the booking may be cancelled and payments made will be handled according to section 3.

2.3 Bank transfer fees are covered by the guest. Rates are quoted in Thai Baht (THB) unless agreed otherwise.

3. Cancellations and Changes

3.1 Cancellations must be sent to us in writing (email is fine). The cancellation takes effect on the day we receive it.

3.2 30 days or more before arrival: payments are non-refundable, but the full amount paid is kept as a credit for up to 9 months from the date we confirm the cancellation. The credit can be used for the same Villa, in the same season or a lower-rate season, subject to availability.

3.3 Less than 30 days before arrival: payments are non-refundable. If we manage to rebook the Villa for the full cancelled period, the 9-month credit described in 3.2 will apply.

3.4 Christmas and New Year period: payments are non-refundable. The 9-month credit applies only if we are able to rebook the Villa for the full cancelled period.

3.5 These cancellation terms also apply if a booking is cancelled because the balance was not paid on time.

3.6 Requests to change your dates are reviewed case by case and may be treated as a cancellation and new booking. Early departures do not automatically qualify for a refund, but talk to us and we will look at what's fair.

4. Insurance

4.1 We ask that everyone in your party has comprehensive travel and health insurance, including cover for cancellation, delays and loss or damage to belongings.

4.2 Escapes to Samui is not responsible for claims arising from third-party services you arrange during your stay, such as car, scooter or boat rentals, water sports or excursions.

5. Damage

5.1 Damage beyond normal wear and tear is charged to the guest based on the repair or replacement cost of the item. Any damage charges are settled before check-out.

5.2 To protect the furniture, please don't sit or lie on indoor furniture while wet or wearing sunscreen, oils or insect repellent.

6. Safety and Children

6.1 Our villas are private homes, often with pools, terraces, stairs and glass balustrades. Pools are not supervised. Please take care around these areas, especially with children, and don't walk indoors while still wet from the pool, as floors can be slippery.

6.2 Children are welcome at many of our villas. Suitability varies per property and is noted on each listing. Parents and guardians are responsible for the safety and supervision of their children at all times.

6.3 Guests use the Villa and its facilities at their own risk. Escapes to Samui is not liable for injury, loss or damage during your stay, except where caused by our own negligence.

7. House Rules

7.1 Smoking. All villas are non-smoking indoors. Smoking is allowed outside by the pool, terrace and parking areas. Please use an ashtray and never throw cigarettes or other items over balconies or into the garden.

7.2 Visitors. For the safety of our guests and staff, only registered guests may stay at or be brought back to the Villa. If you'd like to have visitors, check with us first.

7.3 Respect. Our staff and neighbours are part of what makes each stay work. We don't accept discrimination or disrespectful behaviour towards staff.

7.4 Local law. Illegal activity and the use or possession of illegal substances are not permitted and will be reported to the local authorities.

7.5 In serious cases of misconduct, we may ask guests to leave the Villa. This is treated as a cancellation and no refund applies.

8. Valuables

Valuables left at the Villa are your own responsibility. Please use the safe where available and keep valuables out of sight.

9. If Something Goes Wrong

9.1 Things occasionally break on a tropical island, from power or water outages to pool pumps. We'll always work to get it fixed as quickly as possible, but we can't be held responsible for utility outages or issues outside our control.

9.2 If something isn't right, please contact us within 24 hours so we can sort it out while you're still here. Issues raised after check-out, or not reported during your stay, can't be considered.

9.3 In the rare case a villa becomes unavailable, we will offer a comparable or better alternative.

9.4 Escapes to Samui is not responsible for delays, extra costs or disruptions caused by events outside our control, such as severe weather, floods, fires, civil unrest, government action or island-wide outages.

10. Applicable Law

These terms are governed by the laws of Thailand. Any disputes fall under the exclusive jurisdiction of the courts of Koh Samui, Surat Thani.

11. Agreement

By confirming your booking, you agree to these terms and conditions.

12. Privacy Policy

This policy explains how Escapes to Samui, operated by Indulgent Escapes 2 Samui Co. LTD, collects and uses information through www.escapestosamui.com.

What we collect. We only collect personal details (such as your name, email, phone number and booking details) when you share them with us, for example through an enquiry, booking or chat. You can browse the site without sharing any personal information. We may also collect general technical information, such as browser type, device and connection details.

Cookies. The site uses cookies to improve your experience. You can set your browser to refuse cookies, though some parts of the site may not work properly.

How we use it. We use your details to respond to enquiries, manage your booking and keep in touch before and during your stay.

How we protect it. We use appropriate security measures to protect your information against unauthorised access, changes or disclosure.

Sharing. We never sell, trade or rent your personal information. We only share what's needed with trusted partners involved in your stay (such as a transfer driver or chef you've booked through us).

Changes. We may update this policy from time to time, and the date below will show when it was last changed.
